1. About Us

Phoenix TCG Limited ("Phoenix", "we", "us", "our") is a private limited company incorporated in Ireland under the Companies Act 2014, Company Number 806529. Our registered office is at G1 Calmount Park, Ballymount, Dublin 12, D12 TH56.

We operate an online retail store at www.phoenixtcg.eu selling trading card game products and accessories, including products under the Aegix brand.

2. Acceptance of Terms

By accessing or using our website, placing an order, or creating an account, you agree to be bound by these Terms & Conditions, our Privacy Policy, Cookie Policy, Returns Policy, and Shipping Policy. If you do not agree, please do not use our website.

We reserve the right to update these Terms at any time. The version in force at the time of your order shall apply to that order. We recommend reviewing these Terms periodically.

3. Eligibility

You must be at least 18 years of age to place an order on our website. By placing an order you confirm that you are 18 or over and that all information you provide is accurate and complete.

4. Products & Pricing

We take reasonable care to ensure product descriptions, images, and prices are accurate. However, errors may occasionally occur. Where we discover a pricing error on an order you have placed, we will contact you and give you the option to proceed at the correct price or cancel your order.

All prices are displayed in Euro (€) and are inclusive of VAT where applicable at the rate applicable on the date of your order. Prices do not include delivery charges, which are displayed separately at checkout.

We reserve the right to withdraw any product from sale at any time without notice.

5. Orders & Contract Formation

By placing an order you are making an offer to purchase the selected products. A contract between you and Phoenix TCG Limited is formed only when we send you an order confirmation email.

We reserve the right to decline any order at our sole discretion, for example where a product is out of stock, where a pricing error has occurred, or where we suspect fraudulent activity. In such cases we will notify you promptly and provide a full refund of any payment taken.

6. Payment

We accept payment by debit card, credit card, and other methods displayed at checkout (including Shopify Payments and PayPal). All payments are processed securely through our payment processor. We do not store full card details on our systems.

Payment is taken at the time of order. If payment is declined your order will not be processed.

7. Delivery

Delivery terms, estimated timescales, and charges are set out in our Shipping Policy, which forms part of these Terms. Delivery timescales are estimates only and we are not liable for delays caused by circumstances outside our reasonable control.

Risk in the products passes to you upon delivery. Title passes upon receipt of full payment.

8. Consumer Rights — Right of Withdrawal

If you are a consumer (i.e. purchasing for personal, non-commercial purposes), you have the right to withdraw from your purchase within 14 calendar days of the day on which you receive the goods, without giving any reason, in accordance with the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.

To exercise your right of withdrawal, you may use the withdrawal function on our website (as required under EU Directive 2023/2673), notify us by email at info@phoenixtcg.eu within 14 days, or use the model withdrawal form in our Returns & Refunds Policy. Full details of how to return goods and receive a refund are set out in that policy.

The right of withdrawal does not apply to sealed goods which have been unsealed after delivery and are not suitable for return for hygiene or other reasons, or to goods which have been clearly personalised. Single issues of newspapers, periodicals, and magazines are likewise exempt once dispatched; however, magazine subscriptions do carry the 14-day right (running from receipt of your first issue) — see Section 13.

9. Faulty or Damaged Goods

If goods arrive damaged or faulty, please contact us at info@phoenixtcg.eu within 48 hours of receipt with a description and photographs of the damage. We will arrange a replacement or refund in accordance with your statutory rights under the Sale of Goods and Supply of Services Act 1980 and the Consumer Rights Act 2022.

10. Intellectual Property

All content on this website, including but not limited to text, images, logos, product designs, brand assets, and the Aegix name and mark, is the property of Phoenix TCG Limited or its licensors and is protected by Irish and EU intellectual property laws.

You may not reproduce, distribute, or create derivative works from any content on this website without our prior written consent.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Phoenix TCG Limited shall not be liable for any indirect, consequential, or special loss arising from your use of this website or from any products purchased, except where such liability cannot be excluded by law (including liability for death or personal injury caused by our negligence, or for fraud).

Our total liability to you in connection with any order shall not exceed the total amount paid by you for that order.

12. Data Protection

We process your personal data in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Data Protection Acts 1988–2018. Please review our Privacy Policy for full details.

13. Subscriptions & Auto-Renewal

Some products, including magazine subscriptions, are sold on a recurring basis. By subscribing you authorise us to charge your payment method automatically for each billing cycle — monthly, or for the prepaid term you select — at the price shown when you subscribed, until you cancel.

There is no minimum term: you may cancel at any time after your first billing cycle, from your account or by contacting us. Cancelling stops future renewals; the cycle already paid for is still fulfilled. Prepaid terms run for the term chosen and then renew unless cancelled. Magazine subscriptions carry the 14-day right of withdrawal (Section 8). Full details, including how to cancel, are set out in our Purchase Options Cancellation Policy and Returns & Refunds Policy.

14. Gift Cards

Gift cards (gift vouchers) purchased from Phoenix TCG are valid for 5 years from the date of issue, in line with the Consumer Protection (Gift Vouchers) Act 2019. You are not required to redeem the full value in a single transaction; any remaining balance stays available on the card until it expires, and more than one gift card may be used in a single order. No activation, service, or other fees apply, and the balance does not reduce over time. Gift cards are redeemable only against products on this website. They are non-refundable for a change of mind and are not exchangeable for cash, except where required by law; once a gift card has been redeemed, any remaining balance over €1 may be returned to you as a replacement gift card. Buying a gift card does not earn Gems — Gems are earned when the card is spent on eligible products. Please treat gift-card codes like cash: we cannot replace codes that are lost, stolen, or made available to others.

15. Governing Law

These Terms & Conditions are governed by the laws of Ireland. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Irish courts. Your statutory consumer rights are not affected.
